Our attorneys handle a wide range of civil litigation cases in the Supreme Courts of New York State, Bronx, Kings, New York, Queens, and Richmond counties, as well as in the United States District Courts of the Southern and Eastern Districts of New York. Many of our cases stem from our core practice in buildings matters, such as tort cases for property damage caused by negligent construction, and breach of contract cases between property owners and general contractors (GC), or between GCs and subcontractors.
Challenges to decisions of state or city government agencies are made in New York State courts under Article 78 of the court’s procedural rules. Our firm has initiated hundreds of Article 78 petitions. Some of the most common challenges include denials of DOB license applications, or to suspensions or revocations of licenses; resolutions of BSA regarding applications for variances, special permits, and vested rights determinations; determinations of DCHR or HPD, regarding their enforcement jurisdictions; and ECB verdicts.
Adverse rulings in trial courts must, of course, be appealed sometimes. We have briefed and argued many appeals in the First and Second Departments of the Appellate Division of the New York State court system, and at the Court of Appeals in Albany, the highest court in New York State. We have also handled federal appeals at the United States Court of Appeals for the Second Circuit.
